ERC Is Getting It Together

From the Mindanao Times: “ERC junks Napocor’s petition for basic generation rate adjustment”

Quoting ERC Chairwoman Ducat:

“As an independent, quasi-judicial body, the ERC is duty-bound to decide the cases filed before it on the basis only of substantial evidence. Whether or not NPC is entitled to any increase ultimately depends on what evidence it will submit to the ERC,” said ERC chairerson Zenaida Cruz-Ducut.

“If it submits none that can be given any probative value, as what it did in this case, then the dismissal of its application is a foregone conclusion,” added Ducut.

Back on August 8, in a piece entitled “>”Piecing Together the NPC Puzzle,” I said this:

The NPC Team calmly provided an explanation of their case at the Expository Hearing today. It’s a very weak case. I was astounded that the case is built on utilizing a mix of data from 2000 (I think), 2002, 2004 and current. Is there cherry-picking going on? NPC team seemed unconcerned by initial questions on their approach (I don’t know if that’s a fact, I failed to ask them).

And then Twittered this on Septmber 1.

Cyril must be pulling his hair out. For second time, ERC tells Napocor to re-file.

I am surprised both (1) at the ERC’s eminently correct regulatory decision and (2) NPC’s inability to recover from their blunder.
