Hearing Scheduled on Early Open Access

Here’s the ERC Order (pdf) on setting for Hearing a petition for Early Open Access. It includes, at least in part, the petition.

The petitioners include:

  • PIPPA
  • Meralco
  • VECO
  • Davao Light
  • Cepalco
  • San Fernando EL&P
  • PECO

The petitioners are asking for Interim Open Access (i.e. not according to EPIRA) in Luzon and Visayas (only, i.e. not in Mindanao), implemented according a Terms of Reference (ToR) they have all agreed to.

Some components of the ToR include (condensed version):

  • Eligible customers are initially those with 1 MW of load
  • Six months later, the threshold is reduced to 750 kW
  • Eligible generators are essentially any generator, except NPC and it’s IPPs
  • NPC can participate once the EPIRA thresholds have been met (essentially, 70% privatized)
  • All TSCs stay in place for their full term, except for adjustments for load lost to a privatized NPC generator

Jurisdictional and Pre-Trial (for Luzon) set for June 16, with Evidentiary Hearing June 17.
